Terms of Use
Effective date: October 6, 2026
These Terms of Use (“Terms”) are an agreement between you and DUPICA HOLDINGS LLC (“Dupica,” “we,” “us” or “our”) and govern your use of dupica.com, including dupica.com/es/ (the “Site”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. What Dupica is — and what it is not
Dupica is an online directory that helps people find licensed real estate brokerages and agents in the United States, read public information about them, and request a free, automated home value estimate.
- Dupica is not a real estate brokerage and is not licensed as one. We do not represent buyers, sellers, landlords or tenants, we do not negotiate or take part in transactions, and we do not receive commissions on real estate transactions.
- We do not endorse or guarantee any brokerage or agent. The Dupica Seal and paid plans (Featured, Top City and Top County) mean that a brokerage has shown it controls its profile and has committed to keep its information current and respond to Dupica users. They do not mean that Dupica has audited, certified or recommends that brokerage. Brokerages with paid plans may appear more prominently.
- No professional advice. Nothing on the Site is legal, tax, financial, investment, appraisal or real estate advice. Talk to a qualified professional before making decisions.
2. Home value estimates
Estimates are calculated automatically from public statistics (U.S. Census Bureau American Community Survey and the FHFA House Price Index) and the details you provide. They are informational only, may differ significantly from a property’s actual market value, and are not an appraisal, a broker price opinion or an offer to buy. Do not rely on them for lending, tax, legal or sale decisions.
3. Directory information
Profiles are built from public state license records (Florida DBPR, Texas TREC and Arizona ADRE), information provided by brokerages and agents, and content shown live from Google Maps. We work to keep the information accurate, but we do not guarantee that it is complete, current or error-free. Always verify a license directly with the state regulator. See Data sources.
If you see a profile that is wrong, or you want a profile about you or your business corrected or removed, use our correction or removal form or contact us.
4. Fair housing
Dupica supports the federal Fair Housing Act and state and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex (including sexual orientation and gender identity), disability, familial status, national origin, or any other characteristic protected by law, and we do not allow the Site to be used to do so. Brokerages and agents listed on Dupica are solely responsible for complying with fair housing laws in their advertising and services. If you believe a listing or message violates fair housing laws, please tell us. You can also contact the U.S. Department of Housing and Urban Development (HUD).
5. Your use of the Site
You must be at least 18 years old to submit forms or create an account. You agree not to:
- provide false information, impersonate anyone, or submit requests on behalf of someone without their permission;
- scrape, copy, harvest or download data from the Site in bulk, or use it to build a competing database or to send unsolicited messages;
- interfere with the Site’s security or operation, or use bots or automated means except search engine crawlers that follow our robots.txt;
- use the Site for any unlawful, discriminatory, harassing or fraudulent purpose.
6. Brokerage and agent accounts
If you claim or create a profile, you confirm that you are authorized to act for that brokerage or agent, that the information you provide is accurate, and that you hold the licenses you claim. You are responsible for your account and for keeping your profile up to date. We may verify ownership, ask for documents, and suspend or remove profiles or accounts that break these Terms or the law. Agents who claim their profile must be approved by their brokerage where the Site requires it.
Leads (valuation requests and contact messages) you receive through Dupica may be used only to respond to that person’s request, in compliance with applicable laws, including privacy, telemarketing (TCPA and Do Not Call), CAN-SPAM and fair housing laws. You may not sell or transfer leads to others. If a consumer asks you to stop contacting them or to delete their information, you must honor it.
7. Paid plans
Paid plans for brokerages (Featured, Top City and Top County) are sold and invoiced by our affiliate REAL DIGITAL NETWORK LLC, which is the seller of record. When you buy a plan, you enter into the purchase with REAL DIGITAL NETWORK LLC under these Terms and the plan details shown at checkout.
- Billing: plans are subscriptions billed in advance, monthly or yearly, in U.S. dollars, through our payment processor Stripe. Prices do not include sales tax; applicable taxes are calculated and added at checkout and shown on your invoice.
- Renewal: plans renew automatically at the end of each billing period at the then-current price until you cancel. We will give you at least 30 days’ notice of any price change before your next renewal.
- Cancellation: you can cancel anytime, without a long-term contract, from your dashboard or through the Stripe customer portal linked there. Cancellation takes effect at the end of the current billing period, and you keep the plan’s features until then. Fees already paid are not refundable, except where required by law.
- Placements: Top City and Top County placements are limited and are assigned in order of activation. Plan features are described on our plans page and may change over time; we will not materially reduce the features of a plan during a period you have already paid for.
- Failed payments: if a payment fails and is not resolved, the plan may be downgraded to a free profile.
8. User content and reviews
“User content” means anything you submit to the Site, such as profile descriptions, logos, photos, messages and reviews. You keep ownership of your content, but you grant Dupica a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt (for example, resize or translate) and distribute it to operate and promote the Site. You confirm that you have the rights to the content and that it does not infringe anyone’s rights.
Reviews and other content must be honest and based on real experiences. You may not post content that is false, misleading, defamatory, discriminatory, obscene, threatening, or that contains personal information of others; reviews written in exchange for payment or by people with a conflict of interest (for example, a brokerage reviewing itself or a competitor); spam or advertising; or content that violates any law. We may moderate, refuse or remove content at our discretion. Ratings and reviews shown from Google are Google content, not Dupica’s, and are subject to Google’s policies.
9. Google Maps content
The Site uses Google Maps Platform to show maps, ratings, reviews, photos and business information. This content belongs to Google and its licensors and is provided “as is.” Your use of Google Maps features is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
10. Intellectual property and copyright (DMCA)
The Site, its design, text, software, logos and the “Dupica” name are owned by Dupica or its licensors and are protected by law. Public license records are not claimed as ours. You may view and share pages for personal, non-commercial purposes.
If you believe content on the Site infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent at info@dupica.com with: (1) your physical or electronic signature; (2) a description of the copyrighted work; (3) the URL of the material you claim is infringing; (4) your contact information; (5) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and (6) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner. We may remove the material and, in appropriate cases, terminate repeat infringers’ accounts. If your content was removed, you may send a counter-notice with the information required by 17 U.S.C. § 512(g).
11. Third-party sites
The Site links to websites and services we do not control, such as brokerage websites, state regulators and Google. We are not responsible for their content, policies or practices.
12. Disclaimers
THE SITE AND ALL CONTENT, ESTIMATES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY BROKERAGE OR AGENT WILL CONTACT YOU, BE AVAILABLE, OR PERFORM SERVICES SATISFACTORILY. ANY DEALINGS YOU HAVE WITH A BROKERAGE OR AGENT ARE SOLELY BETWEEN YOU AND THEM.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DUPICA AND ITS MEMBERS, MANAGERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, THESE TERMS, ANY ESTIMATE, OR ANY BROKERAGE OR AGENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS (US$100). Some states do not allow certain limitations, so some of these may not apply to you.
14. Indemnification
You agree to defend, indemnify and hold harmless Dupica from any claims, losses and expenses (including reasonable attorneys’ fees) arising from your user content, your use of leads, your violation of these Terms or your violation of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules, and by applicable federal law. Any dispute will be resolved exclusively in the state or federal courts located in New Mexico, and you and Dupica consent to their jurisdiction, except that either party may bring an individual claim in small claims court. Before filing a claim, please contact us so we can try to resolve it informally. Nothing in these Terms limits rights you have under consumer protection laws of your state of residence that cannot be waived by contract.
16. Changes and termination
We may update these Terms. We will post the new version here with a new effective date and, for significant changes, give additional notice on the Site or by email to account holders. Continuing to use the Site after the changes take effect means you accept them. We may suspend or end access to the Site, or to any account, if these Terms are violated or as needed to protect the Site or its users.
17. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and any plan terms you accept, are the entire agreement between you and Dupica about the Site. The English version of these Terms controls; translations are provided for convenience.
