Florida documentary stamp tax calculator
Enter the sale price and the loan: we calculate the deed tax, the mortgage tax and the intangible tax with the Florida Department of Revenue rates.
How it's calculated
Deeds: $0.70 for each $100 of the total consideration or portion thereof. That "portion thereof" matters: the price is rounded up to the next $100 before applying the rate, so a $250,050 sale pays tax on $250,100. In Miami-Dade the rate is $0.60 per $100, plus a $0.45 per $100 surtax when the deed transfers anything other than only a single-family dwelling (condos, multifamily, land, commercial).
Mortgages: $0.35 for each $100 of the amount secured, or portion thereof, with no cap for a recorded mortgage. On top of that, Florida charges a one-time nonrecurring intangible tax of 2 mills ($2 per $1,000) on obligations secured by a mortgage on Florida real estate. The lender is the taxpayer for the intangible tax, but in a purchase it normally appears among the buyer's closing costs.
Frequently asked questions
How much is the doc stamp tax on a $300,000 house in Florida?
$2,100 on the deed outside Miami-Dade ($300,000 / 100 × $0.70). In Miami-Dade it is $1,800 for a single-family home, or $3,150 if the surtax applies.
Who pays documentary stamp tax in Florida?
The purchase contract decides who pays the deed tax; it is commonly assigned to the seller, but it is negotiable. The tax on the mortgage and the intangible tax come with the buyer's loan, so they normally show up in the buyer's closing costs.
Is there a cap on Florida documentary stamp tax?
Only for notes and other written obligations to pay money that are not secured by a recorded mortgage: their tax is capped at $2,450. There is no cap on deeds or on mortgages.
When is the doc stamp tax paid?
At closing: the closing agent collects it and pays it to the clerk of court when the deed and mortgage are recorded.
